Division with Jurisdiction over Bankruptcy Proceedings

The Division with Jurisdiction over Bankruptcy Proceedings is one of the divisions that form the Court for the Defense of Competition and the Protection of Intellectual Property at Indecopi.

It is the functional entity that hears and settles, in second and last administrative instance, the appeals filed against the rulings/resolutions made in the first instances that are issued finally and conclusively in bankruptcy proceedings that are filed elsewhere in the country.

Likewise, it settles complaints filed by the applicants against the Bankruptcy Proceedings Commissions, their respective technical secretariats and their decentralized offices, against Indecopi Court Divisions and their technical secretariats for hidden defects in the processing of a legal action.

Additionally, the Division with Jurisdiction over Bankruptcy Proceedings rules on requests for clarification, extension and amendment of its own rulings/resolutions.

The Commissions whose rulings/resolutions can be contested before the Division with Jurisdiction over Bankruptcy Proceedings are the following:

  • South Lima Bankruptcy Proceedings Commission
  • North Lima Bankruptcy Proceedings Commission
  • Commissions of Indecopi Regional Offices with decentralized functions in matters of bankruptcy proceedings.

Contribute to providing the debtor and their creditors with an ideal environment for negotiations that will allow them to maximize the assets in the creditor’s meeting or declaration of insolvency and obtain the greatest rate of recovery of the claim, through the speed and predictability of the proceedings.

Be recognized by the institution and its users nationwide as the most effective, efficient, predictable and committed resolution -based body in resolving the matters presented to it, to contribute to the correct operations of bankruptcy proceedings.

Mandate

Ascertain, analyze and settle in the second and last administrative instance, the appeals filed against the first instance rulings/resolutions that are issued finally and conclusively in the bankruptcy proceedings filed nationwide, as well as settle the complaints filed by the applicants against the Bankruptcy Proceedings Commissions, Indecopi Court Divisions and their corresponding technical secretariats for defects in the processing of a legal action.
